Under a <br />determination of a "normal" condition, the annual apportionment is 2.8 <br /> <br />maf for Arizona; 4.4 maf for California; and 0.3 maf for Nevada, which <br /> <br />is a total of 7.5 maf for the Lower Basin. <br /> <br />(fl "Beneficial consumptive use" means consumptive use of water <br /> <br />for purposes allowed under State law in each of the respective Lower <br /> <br />Basin states and/or for purposes which may be determined by the Regional <br /> <br />Director. <br /> <br />(g) "Colorado River System" means that portion of the Colorado <br /> <br />River and its tributaries, including both surface and subsurface flow, <br /> <br />within the boundaries of the United States of America. <br /> <br />(h) "Colorado River water" means mainstream water, as defined in <br /> <br />S 415.4(x). <br /> <br />(1) "Commissioner" means the Commissioner of the Bureau of <br /> <br />Reclamation of the United States Department of the Interior. <br /> <br />(j) "Consumptive use" means both diversions from the mainstream, <br /> <br />as defined in S 415.4(n), including diversions by underground pumping, <br />less such return flow thereto as is available for consumptive use in the <br /> <br />United States or in satisfaction of the Mexican Treaty Obligation, and <br /> <br />evaporative losses from the mainstream resulting from actions taken <br /> <br />subsequent to March 9, 1964 (the date of the Supreme Court Decree in <br /> <br />Arizona v. California\, by individuals or entities which result in a net <br /> <br />increase in the mainstream surface area. <br /> <br />5 <br />
