<br />. <br /> <br />. <br /> <br />recognize the amount, nature, and priority of the entitlement and to <br />establish ths terms and conditions thsreof, including, but not limitsd <br />to: the beneficial consumptive use entitlement associated with the <br />right, the type and place of use, measuring and reporting requirements, <br />administrative fees, criteria for changes in the type or place of use, <br />and other responsibilities of the parties as deemed to be appropriate by <br />the Regional Director. <br /> <br />(4) PPR contracts with non-Indian holders of PPRs. <br />Contracts with non-Indian holders of PPRs are required. Such contracts <br />will be between the Regional Director and the individual or entity <br />holding the PPR and shall recognize the amount, nature, and priority of <br />the right and establish the terms and conditions thereof, including, but <br />not limited to: the beneficial consumptive use entitlement associated <br />with the right, the type and place of use, measuring and reporting <br />requirements, criteria for changes in type and place of use, criteria <br />for forfeiture or reduction of the right for failure to put the right to <br />beneficial use or to properly report such use, administrative fees, and <br />other responsibilities of the parties as deemed to be appropriate by the <br />Regional Director. <br /> <br />(S) Water delivery contracts. Water delivery contracts are <br />written agreements between Reclamation and a non-Federal entity that <br />provide permanent service on a basis other than a PPR and which <br />establish, among other things. the amount of the contractual <br />entitlement, the type and place of use, criteria for establishing the <br />amount of the annual delivery entitlement during times when Colorado <br />River water supplies are insufficient to fully satisfy all entitlements, <br />the amount of the charges and fees associated with the delivery of water <br />and administration of the contract and for adjustment thereof, measuring <br />and reporting requirements, a requirement for approval of assignments or <br /> <br />19 <br /> <br />09S~ <br />
