<br />. <br /> <br />. <br /> <br />transfers and inclusions and exclusions of land in and from a water <br />user's service area before such actions are effective, criteria for <br />forfeiture of or reduction in the contractual entitlement because of <br />failure to put the water to beneficial use, failure to report usage, or <br />failure to pay all charges and fees when due, and other provisions as <br />deemed to be appropriate by the Regional Director. <br /> <br />(6) Surolus contracts. Contracts for Colorado River water <br />may include unused basic apportionment or surplus apportionment when <br />available, or the Secretary may enter into single-purpose contracts for <br />surplus water or unused apportionment, which may be made available to <br />users on an intermittent basis at the discretion of the Regional <br />Director pursuant to a recommendation from appropriate State officials. <br />Surplus contracts will provide water to users on an as-available basis <br />as determined by the Secretary. Surplus contracts shall establish, <br />among other things, the amount of the contractual entitlement, the type <br />and place of use, criteria for establishing the amount of the delivery <br />entitlement, provisions for curtailment of and adjustments to the <br />contractual entitlement, the amount of the charges and fees associated <br />with the delivery of water and administration of the contract, measuring <br />and reporting requirements, a requirement for approval of assignments or <br />transfers and inclusions in and exclusions of land from a water user's <br />service area before such actions are effective, failure to report usage <br />or to pay all charges and fees when due, and other provisions as deemed <br />to be appropriate by the Regional Director. Sources of water available <br />to satisfy demands under surplus contracts include: <br /> <br />(i) Unused basic apportionment, which is comprised of <br />Colorado River water determined by the Secretary to be available and <br />which is not being fully utilized under the various Lower Basin States' <br />basic and/or surplus apportionments; <br /> <br />20 <br />
