~
(0
~
C)

. .

thus presumed to be the Colorado River. The measurement required will
be the static water level (the stabilized water level in a well that is

not pumping water).

(i) The Colorado River is presumed not to be the

source of water to a well if the static water level measured in that

well is above the regulatory surface elevation at the location of that

well.

(ii) The Colorado River is presumed to be the source

of water to a well if the static water level measured in that well is

equal to or below the regulatory surface elevation at the location of

the well.

(iii) The colorado River is presumed to be the source

of water to a well if the static water level measured in that well is

above the regulatory surface elevation and the pumping water level

measured in that same well is below the regulatory surface elevation at

the location of the well. Such a well is presumed to be pumping

commingled water and thus, by definition, Colorado River water.

(iv) In making the determinations under paragraphs
(e)(2)(i) through (e)(2)(iii) of this eection, two types of measurements

may be required:

(A) Static water level -- the stabilized water

level in a well that is not pumping water; and

(B) Pumping water level -- the etabilized water

level in a well that is pumping water, or the static water level less

the stabilized drawdown in the well.

15
