<br />. <br /> <br />. <br /> <br />potential to divert Colorado River water at any likely water surface of <br />Lake Head under normal operations. The fixed elevation will be the top <br />of the fixed spillway crest of Hoover Dam (1,205.4 feet mean sea level <br />elevation); and <br /> <br />B. The elevation at or below which a well would <br />be considered to actually divert Colorado River water. This elevation <br />will be determined by the Regional Director based on the high water <br />surface of Lake. Head for the year and will be reevaluated annually by <br />the Regional Director. <br /> <br />A well within the regulatory surface area and drilled below the <br />elevation described in paragraph (e)(l)(i)A of this section will be <br />deemed to be a potential diverter of Colorado River water and the user <br />will be required to have a contract with the Secretary. <br /> <br />(ii) In areas dominated by Lakes Mohave and Havasu, <br />the highest daily average lake elevations which occur during the <br />calendar year will be used' to determine the regulatory surface in the <br />areas adjacent to said lakes. The high water target surface elevations <br />used to operate these reservoirs are 645 feet for Lake Hohave and 449.6 <br />feet for Lake Havasu. <br /> <br />(iii) In other areas, the regulatory surface will be <br />determined from groundwater levels at the edge of the floodplain away <br />from the river. <br /> <br />(2) Water levels in wells used as a water SUDDlv.. The <br />elevation of the water levels measured in wells used as a water supply <br />will be used to determine if the source of water to these wells is from <br />below the regulatory Bur face elevation at the location of a well, and. <br /> <br />14 <br />
