<br />. <br /> <br />. <br /> <br />If an employee, agent, or contractor of Reclamation is denied access to <br />a well to make the required measurements, that well will be presumed to <br />be pumping colorado River water. <br /> <br />(f) Accountina for water use. All users must: (1) except, for <br />small users as defined in S 415.12(b)(2), install a measurement device <br />acceptable to the Regional Director as provided for in S 415.12(b)(3), <br />(2) account for the diversion and/or consumptive use, as well as surface <br />return flow, of all water from the Colorado River, and (3) keep a record <br />of and report such use to the Regional Director. Reclamation shall <br />provide or maintain and make available records of such use in accordance <br />with Article V of the Decrse. <br /> <br />(g) Determination of unauthorized water use. Any entity using <br />Colorado River water without a contract entitlement from the Regional <br />Director (except in the case of a Federal Establishments' PPR) has no <br />legal right to divert water and is an unauthorized user. Any entity <br />using Colorado River water for purposes not authorized under the Decree <br />or a contract with the Regional Director is making unauthorized use of <br />such water. An entity which is determined by the Regional Director to <br />be either an unauthorized user or making an unauthorized use of Colorado <br />River water may attempt to obtain an allocation of water and a contract <br />entitlement pursuant to S 415.8. If such an entitlement is not <br />obtained, the Regional Director shall proceed in accordance with <br />S 415.22 in order to stop diversions by unauthorized users or for <br />unauthorized uses. <br /> <br />S 415.6 Beneficial Use of Entitlements. <br /> <br />(a) PurDose.
