<br />. <br /> <br />. <br /> <br />(x) "Mainstream water" means water in the main stem of the <br />Colorado River downstream from Lee Ferry within the United States, <br />including the reservoirs and backwaters thereon and the subsurface flow <br />associated therewith, as determined by the Regional Director. <br /> <br />(y) "Mexican Treaty obligation" means the United States <br />obligation under the Mexican Water Treaty between Mexico and the United <br />States, effective November 8, 1945, as supplemented, and obligations <br />associated with Minutes of the International Boundary and Water <br />Commission adopted relevant to said treaty. <br /> <br />(z) "Northerly International Boundary" or "NIB" means that <br />portion of the boundary between Mexico and the United States that is <br />delineated by the border between Mexico and the State of California that <br />extends westerly from the Colorado River. <br /> <br />(&a) "Perfected right" means a water right acquired in accordance <br />with State law, which right has been exercised by the actual diversion <br />of a specific quantity of water that has been applied to a defined area <br />of land or to definite municipal or industrial works and, in" addition, <br />shall include water rights created by the reservation of mainstream <br />water for the use of Federal establishments under Federal law whether or <br />not the water has been applied to beneficial use. <br /> <br />(bb) "Permanent service" means either the water user's perpetual <br />right to receive (1) water in amounts sufficient to satisfy the <br />reasonable beneficial use requirements of the water user's service area <br />for the purposes specified in a contract or (2) the maximum annual water <br />delivery entitlement, whichever is the lesser. A water user's maximum <br />water delivery entitlement may be adjusted due to nonbeneficial use or <br />nonuse, as provided in S 415.10. The term "permanent service" as used <br /> <br />8 <br />
