If such determination is made, the water <br />stored for anticipated Compact delivery requirements shall revert to the <br />ownership of the reservoir which captured such water. <br />If the State Engineer determines that water stored for anticipated <br /> <br />Compact delivery requirements is needed to meet Compact requirements, such water <br /> <br />shall be released Upon demand of the State Engineer and shall be allowed to <br /> <br />flow downstream unimpeded in any manner in the gaging station on the Rio Grande <br />near Lobatos. <br /> <br />I. All water stored in' pre-compact reservoirs prior to the start of the <br />direct flow irrigation season shall be subject to the percentage curtailment <br />in effect at the time such stored water is measured at the gaging station on <br /> <br />the Rio Grande near Del Norte. <br /> <br />III. Underground Water Administration <br />A. Administration of all underground water tributary to the Rio Grande <br /> <br />or the Conejos River will be based on the fact that the delivery of certain <br />quantitites of water pursuant to the Compact constitutes the most senior water <br />commitment in the Rio Grande Basin. As a result, all tributary underground water <br /> <br />diversions from the aforementioned systems may be regulated at those times <br /> <br />and to the extent necessary to deliver the amount of water required pursuant <br /> <br />to the terms of the Compact. <br />B. Diversion of underground water from an aquifer hydraulically connected <br />to surface streams (whether said aquifer. be confined or unconfined) shall be <br />permitted at those times and in those quantities necessary for the permitted <br />beneficial use of such water except as provided in C below.
