Under the provisions of <br />the agreement the County acquired 1) A conditional decree to store <br />approximately 325,000 acre-feet of water for power purposes in the Union <br />Park Reservoir issued by the Water Court in Montrose in Case No. 82CW340. <br />2) Water storage rights for municipal and transmountain diversion <br />pu rposes at Uni on Park Reservoi r fil ed by NECD with the Water Court in <br />Montrose in Case No. 86CW226. 3) All other facilities, structures, <br />rights-of-way, governmental permits, titles, and interests associated <br />with the Union Park Project. From the original decree in Case No. <br />82CW340, NECD retained 4,450 acre-feet at the Rocky Point Reservoir <br />alternate point of diversion. <br /> <br />The County became a substitute Applicant in Case Nos. 86CW226 and 88CWD20 <br />filed by NECO and which are currently pending with the Water Court in <br />Montrose. In addition, Arapahoe County has filed an appl ication with the <br />Water Court in Case No. 88CW178, requesting conditional storage rights, <br />surface water rights, and for a change of water rights. <br /> <br />D. General Project Description <br />The Union Park Project is comprised of a number of different facilities <br />aimed at diverting, storing and delivering unappropriated water to <br />Arapahoe County. These facil ities include Union Park Dam, Union Park <br />Reservoir, aqueduct (tunnels and conduits) to deliver water from Union <br />Park Reservoir to South Platte Basin upstream of Antero Reservoir, Taylor <br />River Diversion, and a pumping / power generation plant.
