<br /> <br />Mr. Paul Petzrick <br />Page 4 <br />June 6, 1979 <br /> <br />Answers to these questions had been covered adequately in the <br />"Proposed Action Plan" submitted to the BU~ in March, 1978. Any <br />additional information will be provided during the Environmental <br />Study. It seems that since the initial right-of-way application to <br />the BlM in August, 1975, it has done nothing more than look for reasons <br />not to initiate the EIS. <br /> <br />Activities by the White River Oil Shale Company since June 'of 1974 <br />in collecting environmental baseline data on the prototype of oil shale <br />traGts, which includes the White River bottoms through the reservoir <br />basin area, have been extensive and exhaustive. Experts in the field <br />of air quality, soil and water resources, geology, biOlogical resources, <br />historic, prehistoric, paleontological resources and aesthetics have <br />combed the area for environmental information for some five years now. <br />The findings of these experts is well documented and it would appear <br />that a reservoir EIS could be prepared using these.documents without <br />much, if any, further' field work. <br /> <br />Permits reqUired before construction of the dam can start: <br /> <br />a. Bureau of land Management Special Use Permit <br />. b. Corps of Engineers 404 permit <br />c. Internal Revenue Service ruling on the state Bond issue. <br />d. Utah State land Board right-of-way for State lands to be <br />inundated by the reservoir or traversed by access roads, <br />pipelines, or powerlines. <br />e. Federal Energy Regulation Commission Permit to construct <br />the Hydro-electric Power Plant at the toe of the proposed <br />dam. <br /> <br />Action taken by the State to date to get the project initiated: <br /> <br />1. Application No. 36979 filed with the State Engineer to <br />appropriate 350 second-feet and 250,000 acre-feet of water <br />from the White River in May, 1965. <br /> <br />2. Application No. 36979-a filed with the State Engineer to <br />segregate 53,000 acre-feet of White River waters for oil <br />shale development in March, 1976. <br /> <br />3. Bingham Engineering ConSUlting Firm contracted with to <br />investigate White River Dam sites in 1974. <br /> <br />4. Geologic investigation and report of selected dam site by <br />Bryce Montgomery in February, 1975. <br /> <br />5. Exploration of foundation and borrow materials report completed <br />in June, 1975. , . . <br />) <br />6. Ute Indian Tribe expressed tribe's desire to participate <br />fully in the development of the White River Dam Project <br />(December, 1975). . L' <br />" <br />
