In the event, hcwever, that the said deli varies to Kansas are <br /> <br />found to be less then the scheduled quanti ties, when evaluated in terms <br /> <br />of the concurrent diversions made by ditches in Colorado. so that, <br /> <br />Caddoa Reservoir being empty, it becomes neoessftt-y to regulate and 1im- <br /> <br />it the diversions made by ditches in Colorado, suoh limitations will be <br /> <br />imposed an the appropriators in Colorado, regardless of theit- looations <br /> <br />above or below Caddow, in accordance with their priorities and rights <br /> <br />as heretof'ore defined under the laws by the Courts of the State of Colo- <br /> <br />rado. <br /> <br />7. <br /> <br />Waters impounded in Caddoa Reservoir at the beginning of the <br /> <br />1943 irrigation season d.o not consti tu.te a surplus supply of water, as <br /> <br />the word surplus is defined in the Stipulation of 1933.
