into account the reoorded historical relations between the diversions

of' said ditohes, the then prevailing needs for rrrigation thereunder,

and the set-vioe thereby to be rendered in behalf of the food emergency

program..

In view of the quanti ties of water impounded in Caddoa Re-

servoir at the beginning of' the 1943 irrigation season and available

for release therefrom during the season, it is contemplated that, with

normal conditions of' natural preoipi tation and runoff and with avet-age

amounts of water entering the river below the reservoir, the agreed

deliveries at the Stateline, for diversion' by ditches in Kansas dudng

the period from April 1 to Oetober I, 1943, will be equalled or ex-

oeeded. In the event, hcwever, that the said deli varies to Kansas are

found to be less then the scheduled quanti ties, when evaluated in terms

of the concurrent diversions made by ditches in Colorado. so that,

Caddoa Reservoir being empty, it becomes neoessftt-y to regulate and 1im-

it the diversions made by ditches in Colorado, suoh limitations will be

imposed an the appropriators in Colorado, regardless of theit- looations

above or below Caddow, in accordance with their priorities and rights

as heretof'ore defined under the laws by the Courts of the State of Colo-

rado.

Waters impounded in Caddoa Reservoir at the beginning of the

1943 irrigation season d.o not consti tu.te a surplus supply of water, as
