FLOOD INSURANCE ADrUNISTRATIOf\l (FIA) PROGRAMS RELATED TO I'II\TER RESOURCES: <br />THE NATIONAL FLOOD INSURANCE PROGRAM <br /> <br />The Flood Disaster Protection Act of 1973 (P.L. 93-234) substantially <br />expanded the National Flood Insurance Program in order to provide better <br />protection to the public and to reduce annual disaster assistance outlays <br />through the increased availability of flood insurance. The Act further <br />defined the flood insurance program and addressed three key areas _0 <br />insurance, flood plain management, and local community consultatton and <br />appeals procedures. <br /> <br />HUD (FIA) publishes information on identified flood-prone communities and <br />notifies them within six months of their tentative identification as such. <br />After such notification, the community must either make prompt application <br />for participation in the flood insurance program or satisfy the Secretary <br />that it is no longer flood-prone, Communities having identified flood- <br />prone areas are required to participate in the flood insurance program by <br />one year from the date of identification, or else they become ineligible <br />for Federally-related financing for projects that would be located in <br />flood-prone areas. <br /> <br />The Act requires owners of property in flood-prone areas to purchase flood <br />insurance if they are to benefit from financial assistance for their prop- <br />erty from the Federal Government or from any Federally-insurance, regulated, <br />or supervised lending institution. <br /> <br />The Act permits Federally-regulated lending institutions to make only <br />conventional mortgage loan funds available for acquisition or constru- <br />tion in the special flood hazard areas of nonparticipatinq communities, <br />after the date the communities should have become eligible for the <br />flood insurance program, but have failed to become program participants. <br /> <br />The Secretary, in carrying out land use responsibilities under the Act, <br />is required to establish procedures assuring adequate consultation with <br />elected officials of local governments, including those whose eligibility <br />under the program has been suspended. Such consultation is specifically <br />required with regard to many areas of local concern, and the Secretary is <br />required to encourage local officials to disseminate information widely <br />on any study undertaken in order to permit submissions of relevant data <br />by interested members of the public. <br /> <br />The Act establishes explicit appeals procedures for both individuals and <br />communities desiring to challenge the Secretary's determinations relating <br />to minimum construction elevation standards. It also sets out the scope <br />of judicial review of such determinations. <br />
