One of the basic purposes of storage in any reservoir is to provide <br /> <br /> <br />water for use in periods of rmusually low flow and drought, and it is just <br /> <br /> <br />such use that is being planned for the service of the Basin. No needed _ter <br /> <br /> <br />will be denied to irrigation or any other preferential beneficial consumptive <br /> <br /> <br />use in any area, and all outstanding Federal pOvTer commitments will be met. <br /> <br /> <br />It has been the consistent policy of the Corps of Engineers, in co- <br /> <br /> <br />operation with other Federal and State interests, to operate the main stem <br /> <br /> <br />reservoirs in f'LliJ. accord v~th the authorizing Flood Control Act of 1944 and <br /> <br /> <br />the O'Mahoney-Millikin Amendment. In light of differences of opinion as to the <br /> <br /> <br />meaning of the O'Maboney-Millikin Amendment with reference to hydro power pro- <br /> <br /> <br />duction, the Chief of Engineers has requested of the U. S. Attorney General an <br /> <br /> <br />interpretation of the meaning of this Amendment in regard to the question of <br /> <br /> <br />legal priority of hydroelectric power generation at the Missouri River main <br /> <br /> <br />stem dams over navigation to the use of _ter in the authorized project in the <br /> <br />Missouri River. <br /> <br />Studies conducted by a subcormnittee of the Missouri Basin Inter-Agency <br /> <br /> <br />Committee have shovm conclusively that sufficient _ter 101ill be available rm- <br /> <br /> <br />der an equitably balanced multiple- purpose river program to provide navigation <br /> <br /> <br />on the Missouri rmder the present "open channel" project authorization for a <br /> <br /> <br />number of decades. <br /> <br />If and when irrigation and other consumptive uses approach the point that <br /> <br /> <br />adequate vrater no longer may be available for this type navigation channel, <br /> <br /> <br />the installation of a system of locks and dams would provide for continuation of <br /> <br />~~+ <br />~~;<,~~ <br />~~~~Jf! <br />I <br />f~jJ <br /> <br />/~;#"::.. ;. <br />;<st~:~. <br />l~~~~~ <br />-'-;~'.".;.
