The Knapp Plan (Cont' d) <br /> <br />operation of Caddoa Reservoir, and to a division of the river and reser- <br /> <br /> <br />voir supplies betv.een the States of Colorado and Kansas, \<lhether for the <br /> <br /> <br />season of 1943 under the 1933 Stipulation. or permanently under a final <br /> <br /> <br />decree of the Supreme Court, it is neoessary to consider. as a part of <br /> <br /> <br />or in addition to the interstate relations, those 0 hangee in physical <br /> <br /> <br />conditions attributable to Caddoa Reservoir whioh cause ohanges in the <br /> <br /> <br />established legal r ela tionsl (1) betmen the individual ditches in Colo- <br /> <br /> <br />rado below Caddoa Reservoir, at times when natural river flows are dis- <br /> <br /> <br />torted by the storo.ge of water in or releases from Caddoa Reservoir; and <br /> <br /> <br />(2) between the two groups of ditches in Colorado, the one above and the <br /> <br /> <br />other below Caddoa, into which they are divided by the intervening 10- <br /> <br /> <br />oation of the reservoir. At times when stored ..ater is being reserved <br /> <br /> <br />for Kansas and the rights of Colorado ditches upstream as against those <br /> <br /> <br />downstream are being administered on a priority basis. as during June <br /> <br /> <br />and July cf 1943, unless an allowance be made for losses in storage that <br /> <br /> <br />burden will fall upon the upstream ditches, sinoe they will be r.equired <br /> <br /> <br />to deliver more water to Caddoa Reservoir than the rights of downstream <br /> <br /> <br />ditohes would entitle them. in the absenoe of Caddoa Reservoir. to claim <br /> <br /> <br />away fram the upstream ditches. The diversions of the upstream ditches, <br /> <br /> <br />under such conditions, will neoessarily be reduced in order to overcame <br /> <br /> <br />the increased losses encountered atCaddoa Reservoir in making deliver- <br /> <br /> <br />ies on the priority basis to ditches downstream. Furthermore, unless an <br /> <br /> <br />understanding is reached between the groups of ditches in ColoradO above <br /> <br /> <br />and below Caddoa. and is reoognized as an inherent feature of interstate <br />
