Knapp for April. l1ay and June of 1943. ,~le oharges <br /> <br /> <br />a~inst Colorado may be valid during April and May, though not to the <br /> <br /> <br />olaimed extent. a question arises as to the validity of any oharges dur- <br /> <br /> <br />ing June. As will be recalled, on l'!8.y 2'). 1943 and oontinuing thereafter <br /> <br /> <br />through June and July. no water vas stored in Caddoa Reservoir to Colo- <br /> <br /> <br />rado's oredit. and the river was sought to be administered on the basis <br /> <br /> <br />of priority both above and below the reservoir. Releases were made of <br /> <br /> <br />sto,red water for delivery at the Stateline as requested by Kansas vater <br /> <br /> <br />offioials. and of river water for diversion by downstream ditohes in <br /> <br /> <br />Colorado in aooordanoe with flows entering the reservoir. which in turn <br /> <br /> <br />were governed by the relative rights of domstream ditches as against <br /> <br /> <br />those upstream. Nevertheless the Knapp formula oharges Colorado with <br /> <br /> <br />3.447 A.F, in June, - meaning that the so-called out-of-priority diver- <br /> <br /> <br />sion upstream, or the so-oalled deficiencies do~stream, or the quanti- <br /> <br /> <br />ties of water exchanged between upstream and downstream ditohes, were <br /> <br /> <br />oaloulated at 3.447 A.F. Such a oharge in June is interesting beoause, <br /> <br /> <br />at the time, some of the upstream ditches ,..ere contending. perhaps with <br /> <br /> <br />justification, that ~nstead of being benafi tted by operations of Caddoa <br /> <br /> <br />Reservoir as now alleged by the Knapp figures, they were being injured. <br /> <br /> <br />Suoh injuries. it was said, resulted from administrative limitations <br /> <br /> <br />imposed on the diversions of the upstream ditches which required them to <br /> <br /> <br />pass do~strea.m. and deliver to Caddoa Reservoir, quantities of water <br /> <br /> <br />greater than would have been needed in the absenoe of Caddoa Reservoir, <br />
