<br />O\}2Z46 <br /> <br />. <br /> <br />. <br /> <br />A1; you recall, it was announced at the May 6, 1998, Board meeting that the Ninth Circuit <br />Court of Appeals ruled to uphold the Arizona District Court's decision regarding the Lake Mead <br />Delta. The Court found that the Service's Biological Opinion was valid and denied the Southwest <br />Center for Biological Diversity's request to reduce the water surface elevation of Lake Mead and to <br />remand the Biological Opinion. Included in the Board folder is a copy of the Ninth Circuit Courts' <br />decision. <br /> <br />Included in the Board folder for your reference is a copy of an announcement of a symposium <br />and workshop scheduled for July 8-9, 1998, entitled "Restoring Natural Function Within a Modified <br />Riverine System: The Lower Colorado River". Mr. Worthley and Mr. Tsay will attend from the <br />Board staff. <br /> <br />Also, included in the Board folder is a letter dated May 6, 1998, from Forest Guardians. This <br />letter was addressed to a number of Federal agencies announcing their intent to sue to enforce <br />provisions of the Clean Water Act, the Endangered Species Act (ESA) and the National <br />Environmental Policy Act (NEP A). The intent to sue is related to the Upper Colorado River, Rio <br />Grande, Costillo Creek and Pecos River Compacts. In summary the requested relief is to prepare <br />an Environmental Impact Statement for each of the river compacts and implementation of the <br />compacts to provide supplemental water allocations to ensure compliance with the Clean Water Act, <br />Endangered Species Act and other relevant environmental laws, No response has been received from <br />the Federal agencies, but I will keep you informed of the status of this issue. <br /> <br />In a related matter, the Defenders of Wildlife (DOW) sent a letter dated March 30,1998, to <br />Reclamation stating that it had failed to include provisions in its' water contracts to safeguard <br />environmental protection for threatened and endangered species. Reclamation replied to DOW on <br />May 12, 1998, stating that it has complied with both NEP A and the ESA for contract actions taken <br />to date and that it intends to comply with applicable Federal Statutes in future contracts, <br /> <br />WESTERN WATER PLANNING <br /> <br />Lavoerson's Guide to the Colorado River <br /> <br />The Water Education Foundation, located in Sacramento, California, is in the process of <br />revising and updating its Layperson's Guide to the Colorado River, which is part of a series of <br />Layperson's Guides, intended to discuss pertinent water issues in an easy-to-understand manner. <br />The Board's staff, as well as several agencies on the Board, the Salton Sea Authority, and other <br />Basin States have provided comments on an initial draft of the document to ensure its accuracy. <br />Included in the Board folder, is a copy of a letter, dated May 27, 1998, from the Foundation <br />requesting that the staff submit any comments it may have concerning the subsequent draft of the <br />document. The Board staff has responded to this request with additional comments. <br /> <br />US Global Change Research Program <br /> <br />Included in the Board folder is a letter, dated May 5, 1998, from the U.S. Geological Survey <br />(USGS) and accompanying Fact Sheet inviting the Board to participate in the Southwest regional <br /> <br />5 <br />
