-9-

water rights would be working on the state engineer's payroll,"

According to Osborne the matter got "very vicious" when John

Samples went out to shut down the well. There was quite a fight

over the proposed breaking of the lock, etc., with Osborne "in

the middle." Nevertheless, an injunction was sought. Osborne

pointed out that so far the city has spent $11,000 on attorney

fees in defending the litigation, when it could have easily ob-

tained reservoir rights outright for much less money and protected

itself on the well. Osborne told them at one time that if they

got shut down the Riverside would be glad to rent them enough

water to keep their grass alive on a temporary basis pending the

outcome of the litigation.

Osborne concluded by saying that the entire episode was "a

tragic mistake." He believes that the mis-understandings and

bitterness arose entirely out of personality conflicts created

by the controversy over the Narrows Dam.

e. Version of Les Canfield

On Thursday, April 6, we interviewed Les Canfield, a Fort

Morgan ci ty councilman who operates a water well dri ll'ing service.

at his office in Fort Morgan. We asked him to tell us about the

".1

'-f

episode involving the Fort Morgan golf course well. Canfield said

that the problem commenced when John L. Samples tried to get the

ci ty to purchase water to cover its well under the new law. (H. B.

1066). The idea was that the water which the city would purchase

.

would be released into the river in exchange for the water pumped

.

from the well. Canfield stated that the well in question was

located over 1/2 mile from the river, although there is a seepage

ditch running near the well and that probably some of the water is

WQOOWARD.CLYDE.SHERAROANOASSOC!ATES

:.;
.'~
~>;;,
..JI;

;J

. ,U i~ -;-
