The order used in this Par! is not intended to <br />convey a sense of hierarchy in that any given requirement is more important that another <br />- rather, proceeding from general to specific simply seems more pragmatic. In general, <br />the progression is: <br /> <br />(I) NHPA (historic property) inquiry; <br />(2) NAGPRA (human remains and/or "cultural items") inquiry; <br />(3) ARPA (archaeological resources) inquiry; <br />(4) Executive Order 13007 (sacred sites) inquiry and American Indian Religious <br />Freedom Act. <br /> <br />B. Actions Subject to Consultation Pursuant to Tbis Part <br /> <br />[NOTE: Most of the text that was here has been moved to part 4, section D. What is here <br />now, and relevant for Part 5, has been substantially rewritten,] <br /> <br />Most actions carried out within the general framework of the AMP will be subject <br />to consultation as provided in Part 4. Actions with the potential to affect historic <br />properties other cultural resources will be subject to consultation under this Part, unless <br />as a result of consultation under Part 4 all of the tribal representatives determine that there <br />is no need for consultation with them under this Part. Such a determination by tribal <br />representatives does not relieve the federal agency with responsibility for the proposed <br />action from its obligations to consult with other signatories to the P A that are not <br />represented in the AMWG, <br /> <br />A federal project, activity, or program that is not specifically addressed in the HPP <br />may be considered an undertaking meeting the definition at 36 CFR 800.16(y) - unless <br />determined by the federal agency not to be an "undertaking" after consultation pursuant to <br />this Part. <br /> <br />C. Meetings for tbe Historic Preservation Plan <br /> <br />There will be at least one meeting per year of representatives of all of the entities <br />that are parties to the P A. Additional meetings will be held if the members of this group <br />determine that a meeting is necessary or if the AMWG requests the P A group to meet to <br />facilitate consultation on a proposed undertaking that is under consideration by the <br />AMWG. Meetings will be scheduled, and notice will be provided, by the Bureau of <br />Reclamation after communication with P A signatories to determine the necessity for a <br />meeting and the agenda item(s) to be discussed. Special efforts will be made to <br />accommodate the Advisory Council on Historic Preservation and the AZ SHPO (which <br />are not members of the AMWG). <br /> <br />23 <br />
