The rights will ensure that the Sponsors <br />may construct, monitor and maintain mitigation sites. <br /> <br />A.3.4.5 Financial guarantees <br /> <br />Sponsors propose to fund monitoring and mitigation activities out of the $60,000 per year <br />contingency/maintenance fund, or normal project revenues if the fund is insufficient. <br />Some public commenters expressed potential concern with this proposal. If the NEP A <br />process determines it to be necessary, implementation of contingent mitigation could be <br />secured by performance bond. A bond of approximately $75,000 should be sufficient to <br />secure such work. See discussion in the SEIR for additional information. <br /> <br />A.3.4.6 Reporting <br /> <br />Beginning at the end of the first year of project operations, an annual report will be <br />submitted to the Corps and Reclamation detailing results of monitoring, planting efforts, <br />and success rates. Photographs and data from observation transects will be provided. <br />Sponsors will continue to produce annual reports until full vegetative cover (and/or <br />functional replacement) has been achieved. Reports will be coordinated with the <br />Wetlands and Riparian Monitoring Reports discussed previously <br /> <br />A.3.4.7 Sunset provisions for unused sites <br /> <br />MEI has predicted that project impacts will be greatest in the first two to three years of <br />operations, then decline asymptotically after that. Project-related wetland impacts, as <br />well as plant regeneration and enhancement, should all be well documented and largely <br />over by the fifth year of operation. The Sponsors therefore request that any requirement <br />to maintain title or binding access to land for indirect mitigation sites "sunset" if the 5- <br />year Post-Operational Wetlands Monitoring Report shows that net wetland losses have <br />not occurred, and further impacts are unlikely. <br /> <br />A.3.5 <br /> <br />Final Wetlands Mitigation Plan <br /> <br />This plan will be updated and converted to the Pinal Wetlands Mitigation Plan for <br />submission to the Corps and Reclamation prior to commencement of project construction. <br />That plan will use the above proposals as a base. The Pinal Plan will include: <br /> <br />. Specific locations, including legal descriptions for indirect impact mitigation <br />sites; <br />. Evidence of Sponsors' capability to acquire the necessary rights (i.e. purchase or <br />option to purchase or lease, or other appropriate legal vehicle) to construct, <br />monitor and maintain mitigation sites; <br />.
