The rights will ensure that the Sponsors
may construct, monitor and maintain mitigation sites.

A.3.4.5 Financial guarantees

Sponsors propose to fund monitoring and mitigation activities out of the $60,000 per year
contingency/maintenance fund, or normal project revenues if the fund is insufficient.
Some public commenters expressed potential concern with this proposal. If the NEP A
process determines it to be necessary, implementation of contingent mitigation could be
secured by performance bond. A bond of approximately $75,000 should be sufficient to
secure such work. See discussion in the SEIR for additional information.

A.3.4.6 Reporting

Beginning at the end of the first year of project operations, an annual report will be
submitted to the Corps and Reclamation detailing results of monitoring, planting efforts,
and success rates. Photographs and data from observation transects will be provided.
Sponsors will continue to produce annual reports until full vegetative cover (and/or
functional replacement) has been achieved. Reports will be coordinated with the
Wetlands and Riparian Monitoring Reports discussed previously

A.3.4.7 Sunset provisions for unused sites

MEI has predicted that project impacts will be greatest in the first two to three years of
operations, then decline asymptotically after that. Project-related wetland impacts, as
well as plant regeneration and enhancement, should all be well documented and largely
over by the fifth year of operation. The Sponsors therefore request that any requirement
to maintain title or binding access to land for indirect mitigation sites "sunset" if the 5-
year Post-Operational Wetlands Monitoring Report shows that net wetland losses have
not occurred, and further impacts are unlikely.

A.3.5

Final Wetlands Mitigation Plan

This plan will be updated and converted to the Pinal Wetlands Mitigation Plan for
submission to the Corps and Reclamation prior to commencement of project construction.
That plan will use the above proposals as a base. The Pinal Plan will include:

. Specific locations, including legal descriptions for indirect impact mitigation
sites;
. Evidence of Sponsors' capability to acquire the necessary rights (i.e. purchase or
option to purchase or lease, or other appropriate legal vehicle) to construct,
monitor and maintain mitigation sites;
. Plans and profiles for use at specific sites;

AS Lateral Hydropower Project

July 2000

.

L<<:...-~",";'.-",-~

~J
