b. The Water shall be released as requested by the Service and in accordance with the provisions and conditions of the MOU. c. The District shall provide advance notification to the Division Engineer for Water Division 5 of the date, time, amount and rate of each release, and provide prompt subsequent notification thereof to the Board. d. The District shall deliver the Water into Muddy Creek at the outlet works of the Reservoir, or the outlet of any other source for the Water allowed hereunder. All of the Water released pursuant to this Agreement will be measured by the District at the USGS gage below the outlet works of the Reservoir or such other source's outlet works. The District shall keep accurate records of all releases and provide copies to the Board upon request. e. The Board shall be responsible for calling upon the State Engineer or the Division Engineer for Water Division 5 for the carriage or delivery of the Water from such outlet works to and through the 15-Mile Reach. The deliveries of the Water shall be subject to such transit losses as may be imposed by the State Engineer or the Division Engineer. f. By February I of each year, the District shall provide the Board with an accounting of all releases made during the previous calendar year. g. The Board shall not be responsible for the storage of water in, or for the operation or maintenance of, the Reservoir or other facilities which are physical sources of the Water. h. The Water shall be used by the Board for instream flows in the 15-Mile Reach to preserve the natural environment to a reasonable degree. The Board will use the Water only for such purposes. No lease, sale, loan, donation, or any other disposal of the Water is permitted, and the Board shall not compromise, subjugate, or in any marmer encumber the Water. 4
