<br />b. The Water shall be released as requested by the Service and in accordance <br />with the provisions and conditions of the MOU. <br /> <br />c. The District shall provide advance notification to the Division Engineer for <br />Water Division 5 of the date, time, amount and rate of each release, and <br />provide prompt subsequent notification thereof to the Board. <br /> <br />d. The District shall deliver the Water into Muddy Creek at the outlet works of <br />the Reservoir, or the outlet of any other source for the Water allowed <br />hereunder. All of the Water released pursuant to this Agreement will be <br />measured by the District at the USGS gage below the outlet works of the <br />Reservoir or such other source's outlet works. The District shall keep <br />accurate records of all releases and provide copies to the Board upon request. <br /> <br />e. The Board shall be responsible for calling upon the State Engineer or the <br />Division Engineer for Water Division 5 for the carriage or delivery of the <br />Water from such outlet works to and through the 15-Mile Reach. The <br />deliveries of the Water shall be subject to such transit losses as may be <br />imposed by the State Engineer or the Division Engineer. <br /> <br />f. By February I of each year, the District shall provide the Board with an <br />accounting of all releases made during the previous calendar year. <br /> <br />g. The Board shall not be responsible for the storage of water in, or for the <br />operation or maintenance of, the Reservoir or other facilities which are <br />physical sources of the Water. <br /> <br />h. The Water shall be used by the Board for instream flows in the 15-Mile <br />Reach to preserve the natural environment to a reasonable degree. The Board <br />will use the Water only for such purposes. No lease, sale, loan, donation, or <br />any other disposal of the Water is permitted, and the Board shall not <br />compromise, subjugate, or in any marmer encumber the Water. <br /> <br />4 <br />
