<br />1. Definitions. As used herein, the term: <br /> <br />a. The "I5-Mile Reach" means the reach of the Colorado River from the <br />headgate of the Grand Valley Irrigation Company's diversion ditch (the <br />"head" of the Reach) downstream to the confluence of the Colorado River <br />and Gunnison River (the "tail" of the Reach). <br /> <br />b. The "Reservoir" means Wolford Mountain Reservoir, for which conditional <br />and absolute water storage rights have been adjudicated by the Decrees <br />referenced in Explanatory Recital No, 2 above, <br /> <br />c. The "Water Rights" mean the conditional and absolute water storage rights <br />evidenced by the Decrees referenced in Explanatory Recital No.2 above. <br /> <br />d. The "Water" means storage water which is the subject of this Agreement and <br />which is available pursuant to exercise of the Water Rights; and storage water <br />which is available to the District pursuant to other rights appropriated for or <br />transferred to the Reservoir which are acceptable to the Board, the acceptance <br />of which shall not be unreasonably withheld; and any water available in <br />substitution therefor pursuant to Subsection V,B of the MOD. <br /> <br />2. Loan. Delivery and Dse of the Water. <br /> <br />a. The District hereby loans the Water to the Board for and during the term of <br />this Agreement. The amount of the Water shall be up to and not more than <br />6,000 acre feet of water available annually subject to the terms and conditions <br />of this Agreement. The actual annual amount of the Water shall be <br />determined annually as provided in Section IV.A of the MOD. The District <br />shall notify the Board and the Division Engineer for Water Division 5 of the <br />amount of water available and the pattern of delivery, and any changes <br />thereto. The word "annual" as used herein refers to a calendar year. <br /> <br />3 <br />
