WILDERNESS ACCESS: <br /> <br />Helicopter access to diversion sites! within the Holy Cross Wilderness <br />will be prohibited except for emergehcy purposes or where approved by <br />the Regional Forester. (FEIS Section 2.4.1, page 2-37) <br /> <br />22. PERFORMANCE BOND: <br /> <br />As a further guarantee of the faithful performance of the provisions <br />of this Stipulation, the Grantee a,grees to deliver and maintain a <br />surety bond in the amount of $250,000 prior to starting construction. <br />Prior to undertaking additional con~truction or alternative work not <br />provided for in the above clauses, or when the improvements are to be <br />removed and area restored, the Gran'tee shall deliver and maintain a <br />surety bond in the amount set by the Forest Service, which amount <br />shall not be in excess of the estimated loss which the Grantor would <br />suffer upon default in performance of this work. Should the sureties <br />or the bonds delivered under this Stipulation become unsatisfactory to <br />the Forest Service, the Grantee sh'all, within thirty (30) days of <br />demand, furnish a new bond with su~ety, solvent and satisfactory to <br />the Forest Service. In 1 ieu of surety bond, the Grantee may depos i t <br />into a Federal Depository, as dir~cted by the Forest Service, and <br />maintain therein, cash in the amounts provided for above, or negoti- <br />able securities of the Grantee having a market value at time of <br />deposit of not less than the dollar amount provided above. <br /> <br />The Grantee's surety bond will be released, or deposits in lieu of <br />bond will be returned, thirty (30) 1 days after certification by the <br />Forest Service, and upon furnishing by the Grantee of proof satis- <br />factory to the Forest Service that ~11 claims for labor and material <br />on said installations have been pai~ or released and satisfied. The <br />Grantee agrees that all moneys deposited under this Stipulation may, <br />upon failure on his part to fulfill iall and singular the requirements <br />herein set forth or made a part hereof, be retained by the Grantor to <br />be applied as far as may be to the, satisfaction of this obligations <br />assummed hereunder, without prejudic~ whatever to any other rights and <br />remedies of the Grantor. <br /> <br />23. TRAVEL MANAGEMENT AND DUST CONTROL: <br /> <br />The Grantee will develop and implem~nt, after approval by the Forest <br />Supervisor, a Travel Management Plan that identifies pub1 ic access <br />roads and provides for publ ic safety, necessary road improvement and <br />maintenance, mitigation of increased traffic effects to wildlife and <br />recreati ona 1 users, and the proteqti on of structural improvements. <br />(FEIS Section 2.4.1, page 2-38, Sectpon 4.1.13, pages 4-46 and 4-47) <br />I <br />The Grantee will post and maintai~ warning and traffic regulation <br />signs on Homestake and other serviqe roads in accordance with Eagle <br />County traffic and safety regulations.
