This grant is issued for a period of 50 years ending December 31, <br />2033, but is renewable provided Grantee will comply with the <br />then-existing rules and regulations governing the occupancy and <br />use of National Forest lands. If necessary in order to meet <br />changing times and conditions, this grant may be revised after 30 <br />years from the date of issuance. <br /> <br />2. The Grantee will pay to Grantor the sum of $208.00 for the period <br />from the date hereof to December 31, 1983. and thereafter on <br />January 1, will pay the sum of $357.00. The charges for this use <br />may be readjusted, every five years if necessary, to place the <br />charges on a basis commensurate with the value of use authorized <br />by this easement. <br /> <br />3. A late payment charge in addition to the regular fees shall be <br />made for failure to meet the fee payment due date or any of the <br />dates speci fied for submi ssi on of statements requi red for fee <br />calculations. The late payment charge shall be $15 or an amount <br />calculated by applying the current rate prescribed by Treasury <br />Fiscal Requirements Manual Bulletins to the overdue amount for <br />each thirty-day period or fraction thereof that the payment is <br />overdue, whichever is greater. If the due date falls on a non- <br />workday, the late payment charge will not apply until the end of <br />the next workday. <br /> <br />4. Upon demand, the Grantee shall pay to the United States such sums <br />as the Grantor shall determine to be required, but not to exceed <br />$40,000 annually, to reimburse the United States for admi ni stra- <br />tive costs incurred directly by the United States in inspection <br />and monitoring the construction, operation, and termination of <br />the facilities pursuant to this easement. This condition shall <br />only apply after such time as the Secretary of Agriculture pro- <br />mulgates regulations for cost recovery. <br /> <br />5. This grant is subject to all outstanding valid rights existing on <br />the date of the grant. <br /> <br />6. This grant shall not be conveyed, or otherwise transferred in <br />whole or in part, without the advance written approval of the <br />Regional Forester. <br /> <br />7. The Regional Forester may take action to suspend, revoke, or <br />terminate this easement: (1) upon abandonment; (2) for non- <br />compl iance with any conditions of this grant, provided however, <br />that the Grantee shall have been given written noti ce of the <br />grounds for such action and reasonable time to cure any noncom- <br />pliance. Such action will be in accordance with the Rules of <br />Practice Governing Formal Adjudicatory Proceedings and instituted <br />by the Secretary under 7 CFR 1.130-1.151. <br /> <br />3 <br />
