storage as discussed in Article 3(a)(i), Reclamation will advise the Contractor of such necessity <br />and of the quantity to be released and of the time of such releases, and any release so made shall <br />be as if made on the demand of the Contractor. <br />b. This Contract is only for non - project water and project water return flows that will be used <br />within the boundaries of the Southeastern Colorado Water Conservancy District in accordance <br />with Article 13 of Contract No. 5- 07- 70- W0086. If the Contractor wants to store non - project <br />water that will be used outside of the boundaries of the Southeastern Colorado Water <br />Conservancy District, the Contractor must obtain a separate contract for that water, which will be <br />at the rate for out -of- district entities. <br />C, The Contractor shall be solely responsible for making whatever arrangements under Colorado <br />water laws that are necessary for making water available to the Contractor for storage in Pueblo <br />Reservoir. Reclamation will not store water for the Contractor without prior approval of the <br />State of Colorado's Division of Water Resources. <br />d. The Contractor hereby grants Reclamation permission to move water into and/or out of any of <br />the reservoirs of the Fryingpan- Arkansas Project (Project) storage system to optimize the use of <br />the available storage space and to conserve water. <br />e. Any water imported from the western slope of Colorado remaining in Pueblo Reservoir after <br />expiration of this Contract shall become Project owned water. Any water stored under an east <br />slope decree remaining in Pueblo Reservoir shall be evacuated at expiration of this Contract <br />unless other contractual arrangements have been made. <br />f. The Contractor shall not sell, sublease, donate, loan or in any other manner transfer the use of <br />the storage space contracted for herein to any other entity or individual without written approval <br />of the Contracting Officer. <br />g. Water stored under this Contract is limited to the waters identified in the questionnaire <br />pursuant to this Contact. <br />The charge to the Contractor for storage of water in Pueblo Reservoir shall be an advance <br />nonrefimdable payment of $70,100.00 for 2500 acre -feet of storage capacity at the rate of $28.04 <br />per acre -foot. <br />2 <br />
