Upon the Contractor's demand and after payment as provided in Article 4 hereof, Reclamation <br />will deliver to the Contractor the water stored for the Contractor at the outlet works of Pueblo <br />Reservoir. Such delivery will be at rates required by the Contractor, subject to the available <br />capacity of the outlet works and operational limitations. Notwithstanding the first sentence of <br />this Article, stored water may be delivered at the outlet works of any other dam, provided that an <br />appropriate exchange has been arranged by the Contractor, in accordance with Colorado law and <br />has the approval of the State of Colorado's Division of Water Resources and the Contracting <br />Officer. Any exchange of the Contractor's water with Project water will require a separate <br />exchange agreement with Reclamation. The Contractor understands Reclamation may decline to <br />enter into such an agreement. Reclamation is not responsible for any transportation losses <br />assessed by the State of Colorado's Division of Water Resources and/or associated with the <br />delivery of the Contractor's water from the point of delivery at the outlet works of Pueblo Dam <br />or other dams to the place of use. <br />6. RECORDS AND ACCOUNTING FOR WATER <br />Reclamation shall maintain daily accounting of the Contractor's water showing: <br />a. the amount of Contractor water placed into storage in Pueblo Reservoir each day, <br />b. the amount delivered to the Contractor, <br />c. the evaporation losses charged by Reclamation against Contractor water, which shall be on a <br />prorata basis with all other water stored in Pueblo Reservoir, <br />d. the amount of water remaining in storage at the end of each day (Midnight). <br />The Contractor will furnish Reclamation without charge such Contractor records as may be <br />required for such daily accounting and is required to internally account for any project return <br />flow water stored in this account on a daily basis. <br />7. LIABILITY <br />Reclamation shall not be responsible beyond the point of delivery for control, carriage, <br />transportation losses, handling, use, disposal, or distribution of water stored pursuant to this <br />Contract, and the Contractor shall hold Reclamation harmless on account of damage, or claim for <br />damage of any nature whatsoever arising out of or connected with the control, handling, use, <br />disposal, or distribution of such water beyond the point of delivery. <br />8. RECLAMATION REFORM ACT <br />This Contract is subject to the Reclamation Reform Act of 1982 as administered pursuant to <br />Contract No. 5- 07- 70 -WO086 between the United States and the Southeastern Colorado Water <br />
