Staff of the Board requested that Policy 2000-4 be
amended to remove paragraph no. 3 of the policy, which states as follows:
3. No pumping equipment shall be installed in a gravel pit well or pond well to
withdraw water for any beneficial use, unless a separate written request for
variance has been approved by the Board.
The Board's Rules and Regulation for Water Well Construction, Pump Installation,
Cistern Installation, and Monitoring and Observation Hole/Well Construction, 2 CCR-402-
2 (2013) ("Construction Rules") do not provide any guidance on the requirements for the
installation of pumping equipment in gravel pit or pond wells.
In subsequent discussions between Staff and Counsel for the Board, Staff have
recommended further deleting paragraph no. 4 from the policy, which states as follows:
4. Water from a gravel pit well or pond well shall not be used for human
consumption without separate approval from the Board.
The Board has no statutory or regulatory jurisdiction over the use of water for human
consumption, and Staff have no guidance or regulatory authority to issue an approval or
denial to use gravel pit or pond well water for human consumption.
In drafting the policy revisions as requested by Staff, Counsel recommended minor
alterations in the language of the remaining paragraphs for clarity and accuracy.
Therefore, Staff requests that the Board consider removing paragraphs no. 3 and no. 4
from Policy 2000-4, revising the language of the remaining paragraphs, and re -issuing the
policy in a revised form.
CORRECTION
After the Board adopted Policy No. 2014-1 at its April 1, 2014 meeting, Board staff
conferred with Division of Water Resources (DWR) staff regarding the new policy. DWR
staff alerted the Board staff that certain statutory references in the Policy were
OCTAVE GEORGE B'-OUIN, La Vela; THERESA JEHN-DMAPORT, Coleco, JAROD KLNTZ Sled ng, ANDREW M ROSS, Dever
