Hickenlooper <br />BOARD POLICY NO. <br />2014-1 (CORRECTED) Governor <br />Mike King <br />Revision to Board Policy 2000-4 Regarding Exception for Executive Director, DNR <br />Gravel Pit Wells and Pond Wells Scott Cuthberlson, P E. <br />Secretary <br />INTRODUCTION <br />At its meeting on January 7, 2014, the Board of Examiners of Water Well Construction <br />and Pump Installation Contractors reviewed Board Policy 2000-4, Exception for Gravel Pit <br />Well Amended to Include 'Pond Wells. Staff of the Board requested that Policy 2000-4 be <br />amended to remove paragraph no. 3 of the policy, which states as follows: <br />3. No pumping equipment shall be installed in a gravel pit well or pond well to <br />withdraw water for any beneficial use, unless a separate written request for <br />variance has been approved by the Board. <br />The Board's Rules and Regulation for Water Well Construction, Pump Installation, <br />Cistern Installation, and Monitoring and Observation Hole/Well Construction, 2 CCR-402- <br />2 (2013) ("Construction Rules") do not provide any guidance on the requirements for the <br />installation of pumping equipment in gravel pit or pond wells. <br />In subsequent discussions between Staff and Counsel for the Board, Staff have <br />recommended further deleting paragraph no. 4 from the policy, which states as follows: <br />4. Water from a gravel pit well or pond well shall not be used for human <br />consumption without separate approval from the Board. <br />The Board has no statutory or regulatory jurisdiction over the use of water for human <br />consumption, and Staff have no guidance or regulatory authority to issue an approval or <br />denial to use gravel pit or pond well water for human consumption. <br />In drafting the policy revisions as requested by Staff, Counsel recommended minor <br />alterations in the language of the remaining paragraphs for clarity and accuracy. <br />Therefore, Staff requests that the Board consider removing paragraphs no. 3 and no. 4 <br />from Policy 2000-4, revising the language of the remaining paragraphs, and re -issuing the <br />policy in a revised form. <br />CORRECTION <br />After the Board adopted Policy No. 2014-1 at its April 1, 2014 meeting, Board staff <br />conferred with Division of Water Resources (DWR) staff regarding the new policy.
