Therefore, this Policy 2014-1 corrects those statutory references and includes <br />no additional substantive edits from the original Policy adopted April 1, 2014. <br />DISCUSSION <br />Under the provisions of sections 37-90-107 and 37-90-137, C.R.S., the Colorado Ground <br />Water Commission and the State Engineer, respectively, issue well permits for gravel pits <br />and ponds that expose groundwater to the atmosphere. Because such well permits contain <br />the requirement that construction of a gravel pit "well" and pond "well" comply with the <br />Board's Construction Rules, the Board issued Resolution 90-1 in 1990 to grant a general <br />variance for gravel pit wells from certain inapplicable construction standards, and issued <br />Board Policy 2000-4 to amend the exemption provided in Resolution 90-1 to include "pond <br />wells." Board Policy 2000-4 also modified Resolution 90-1 to update and coordinate the <br />rule numbers of the Resolution in accordance with the revised Construction Rules <br />promulgated in 2000. <br />The Water Well Construction Rules (2005) contain a number of specific provisions <br />regarding the construction of gravel pit wells. Rule 10.1.6 exempts gravel pit wells <br />permitted under sections 37-90-107(6) or 37-90-137(11), C.R.S., from the minimum <br />construction and location standards of Rule 10, although the owner must ensure <br />construction of such well prevents contaminants from entering the gravel pit well. Rule <br />15.1 exempts gravel pit wells from the requirement that all materials installed in wells <br />must be thoroughly cleaned and disinfected. Rule 17.1.4 prescribes an alternate form of a <br />well construction report for the owner of a constructed gravel pit well. <br />Resolution 90-1 and Board Policy 2000-4 were intended to clarify that "pond wells" are to <br />be treated the same as "gravel pit wells" under the Construction Rules and the Board's <br />internal variance approval process. This revision to those policies is intended to eliminate <br />unnecessary provisions and streamline the Board's limited oversight of such "wells" under <br />the Construction Rules and sections 37-91-109 and 37-91-110, C.R.S. <br />POLICY <br />Having considered the presentation, reviewed the material presented, and in furtherance <br />of the concepts embraced in Resolution 90-1, Board Policy 2000-4, the Construction Rules, <br />and sections 37-91-109 and 37-91-110, C.R.S., the Board hereby adopts the following <br />policy: <br />1.
