Walther <br />Executive Director, DNR <br />Hal D. Simpson, P.E <br />Secretary <br />INTRODUCTION: <br />Under section 37-91-106(2) C.R.S. (2002), a license is not required for a person who <br />performs labor or services if directly employed by, or under the supervision of, a licensed <br />well construction or pump installation contractor. This statute requires supervision of <br />those persons performing labor or services who are not directly employed by a licensed <br />contractor. <br />Section 37-91-102(15.5), C.R.S. (2002) provides that a licensed water well construction <br />and/or pump installation contractor can obtain an exemption from the "personal and <br />continuous on -the -site" provision for supervision. Under the newly revised statute, <br />which takes effect on July 1, 2003, this exemption must be obtained from the Board of <br />Examiners. Because exemptions are often needed on short notice and because the Board <br />only meets every other month, the Board cannot address requests for exemptions in a <br />timely manner. <br />Section 37-91-104(2), C.R.S. provides that the Board can delegate certain duties to the <br />State Engineer. Delegation of authority to the State Engineer to perform certain duties is <br />necessary for the efficient and affective operation of the Board and for timely response to <br />requests from contractors and the public. The Board has established basic criteria and <br />guidelines for granting an exemption to personal and continuous on -the -site supervision <br />by a licensed contractor. <br />POLICY: <br />To address the need to provide exemptions in a timely manner to the requirement for <br />personal and continuous on -the -site supervision by licensed water well construction <br />and/or pump installation contractors, the Board hereby adopts the following policy: <br />In accordance with Section 37-91-104(2), C.R.S., the Board of Examiners of Water Well <br />Construction and Pump Installation Contractors hereby delegates to the State Engineer <br />the authority to grant exemptions to continuous on -the -site supervision as described in <br />Section 37-91-102(15.5) pursuant to the criteria and guidelines stated below: <br />1.
