ADMINISTRATION GUIDELINE <br />Accounting Acquisition & Review <br />Division One — South Platte River <br />This guideline is intended to promote a systematic approach to the process of reviewing <br />accounting required for the administration of water in the South Platte River basin. <br />Submittal <br />Accounting must be submitted by water users as necessary to confirm that diversions and <br />replacement are made in accordance with the statutes of the State of Colorado, the prior <br />appropriation doctrine and decrees of the court. The division engineer will purpose to obtain all <br />accounting directed by decree, however, may only vigorously pursue the submission of <br />accounting that is, in the opinion of the division engineer, reasonably necessary to conduct the <br />business of administration within the resources allocated to the Division. As discussed below, <br />all accounting obtained by the division engineer is available to the public. In the event a party, <br />other than the court, makes a request for accounting that the division engineer does not <br />currently have, the division engineer may or may not immediately obtain the accounting based <br />on a number of factors such as the urgency of the issue raised, availability of resources, etc. <br />If accounting is not submitted timely as required by decree, the following steps will be taken: <br />• An e-mail reminder will be sent to the party submitting accounting and plan manager 5 <br />days after the accounting is due. The notice will state that an order will be sent to submit <br />accounting if we do not receive accounting within 15 days. The notice concerning <br />irrigation well user plans will indicate that any order to submit accounting will be copied <br />to all well users under the plan. <br />• If accounting still is not submitted by the 20th day, the Division Engineer will send the <br />party submitting accounting and the plan manager an order to submit accounting within <br />10 days. In the case of irrigation well user plan accounting, the order will state that all <br />users will be issued a cease and desist order if accounting is not submitted timely. The <br />order concerning irrigation well user plan accounting will be copied to all well users <br />under the plan. In the case of municipal providers, the order will state what further legal <br />action will be taken if accounting is not received timely. The appropriate action to be <br />taken concerning municipal providers will be determined based on the specifics of the <br />situation. <br />• If accounting still is not submitted by the 30th day, the Division Engineer will issue orders <br />consistent with the bullet above. <br />Extensions to the deadlines enumerated may be allowed based on extenuating circumstances. <br />Review <br />All accounting will be reviewed and audited as equitably and frequently as possible based on <br />the availability of resources. Audit of the accounting will be conducted to confirm: <br />■ the accounting complies with the requirements of the decree <br />■ the accounting adheres to standard accounting principles; <br />■ the accounting uses the correct formulas and associations based either on the terms <br />and conditions of the decree or administration practices accepted by the division <br />engineer; and, <br />Administration Guideline —Accounting <br />February 5, 2009 <br />
