June 28, 2019 <br />COLORADO <br />Division of Water Resources <br />Department of Natural Resources <br />Ms. Cristyn Radabaugh, PE <br />Martin and Wood Water Consultants, Inc. <br />538 Commons Drive <br />Golden, CO 80401 <br />Re: Super Ditch with the City of Fountain Interruptible Water Supply Agreement <br />Section 19, T22S, R58W, 6th P.M., Otero County <br />Water Division 2, Water District 17 <br />SWSP Plan ID 6082, WDID No. 1707702 <br />Approval Period: July 1, 2019 through December 31, 2028 <br />Contact Information for Ms. Radabaugh: 303-526-2600; , <br />Dear Ms. Radabaugh: <br />We have reviewed your engineering report dated April 12, 2019 requesting an Interruptible <br />Water Supply Agreement ("IWSA") on behalf of the Lower Arkansas Valley Super Ditch <br />Company ("Applicant" or "Super Ditch"), pursuant to section 37-92-309, C.R.S. and the IWSA <br />Rules (2 CCR 402-15). <br />As described in 37-92-309(3), C.R.S., the State Engineer is authorized to approve and <br />administer IWSAs that permit a temporary change in the point of diversion, location of use, <br />and type of use of an absolute water right without the need for an adjudication subject to <br />certain limitations. An IWSA cannot be exercised for more than three years in a ten-year <br />period, for which only a single approval is required. The ten-year period begins with the <br />granting of the approval. <br />Notice was sent to all parties who have subscribed to the SWSP notification list for Water <br />Division 2 on April 12, 2019. No comments were received during the statutory 35 -day <br />comment period. The statutory $3,245 filing fee has been received and given receipt no. <br />3691380. <br />Super Ditch proposes to lease the use of certain shares in the Catlin Canal Company as the <br />source of a temporary municipal supply to the City of Fountain ("Fountain"). Applicants <br />propose to use the historical consumptive use credits associated with the operation of 192 <br />Catlin Canal shares historically used to irrigate 236 acres to transfer to Fountain for municipal <br />use. This will be done by delivering the historical consumptive use credit associated with the <br />shares through the Catlin Canal to two existing Catlin Canal augmentation stations (Timpas <br />Creek WDID [1700800] and Crooked Arroyo [1700801]) where water will travel to the Arkansas <br />OF LOCO <br />1313 Sherman Street, Room 821, Denver, CO 80203 P 303.866.3581 www.cotorado.aov/water o <br />Jared S.
