Enforcement Items and Actions <br />Enforcement actions performed by staff this quarter are summarized below: <br /> <br />Northern High Plains Basin <br />-Pursuant to the Republican River Measurement Rules, as of March 1, 2009 all active large capacity wells within the Republican River Basin were required to be equipped with a water measurement <br /> device and verified in the field by a qualified well tester. At this time, staff have identified 46 wells operating out of compliance with the Measurement Rules as a result of failed <br /> well tests. Staff has begun the process of drafting enforcement letters to send out to the 46 well owners. <br /> <br />-It was discovered that Heritage Farms has been using a small capacity well to supplement the irrigation of a large capacity well permitted for irrigation. The owners have been contacted, <br /> and Staff is currently working them to get the well into compliance. <br /> <br /> Kiowa Bijou Basin <br />-Staff identified a large capacity well without a permit being used for irrigation. A show cause letter was sent to the owner, Albert Johnson, resulting in his submittal of an application <br /> for a determination of water right (as suggested in our letter). Upon issuance of Water Right Findings and Orders, Mr. Johnson should be able to permit the well pursuant to the determination <br /> of water right. <br /> <br />- Roy and Joyce Leake were identified as using a small capacity well, permitted for domestic purposes, in a commercial business (poultry operation). A show cause letter has been sent <br /> to the owners and we are awaiting their response. <br /> <br />Upper Black Squirrel Creek Basin <br />-Samuel and Carlene Leffler failed to respond to our show cause letter regarding the use of their small capacity commercial well in three commercial businesses instead of one as it was <br /> permitted for. A field inspection was performed verifying the violation, and staff is proceeding with further legal action. <br /> <br /> <br />Miscellaneous <br /> <br />Chris Grimes continues to spent considerable time and effort assisting the new Republican River Well Measurement team and reviewing Power Conversion Coefficient and flow meter test report <br /> forms being submitted by well owners. <br /> <br />Staff prepared for and spent 2 weeks during June in a hearing concerning Cherokee Metropolitan District’s proposed replacement plan, case no. 08-GW-71 <br /> <br />Movement of personal within DWR to accommodate work load in all teams statewide continues to leave the Designated Basin’s team with 2 empty positions which will not be filled in the <br /> foreseeable future due to the State’s current hiring freeze. <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />Memorandum <br />Upcoming Commission Meeting <br />Page 2 <br /> <br /> <br /> <br />C.
