Staff Activity Report <br /> August 16, 2025 GWC Meeting <br /> Page 6 of 7 <br /> overpumping by these specific owners of the associated wells may constitute <br /> contempt of the District Court's orders and may result in remedial and punitive <br /> sanctions. <br /> Lost Creek <br /> Lost Creek GWMD <br /> • Rocky Mountain Rail Park Metro District violated the "place of use" terms and <br /> conditions of water rights 3627-BD and 3628-BD, selling water from large <br /> capacity wells (issued pursuant to the water rights) for use in the Town of <br /> Bennett. A Notice of Violation letter was sent to the Metro District following <br /> our confirmation of the violation, and the manager reached out to staff to <br /> resolve the matter, indicating it was her understanding that the place of use <br /> extended into Bennett. Following Staff's review of the water rights and well <br /> permits with the Metro district, they agreed to cease the use of water in the <br /> unauthorized location and potentially seek a change in the place of use of the <br /> backing water rights. <br /> • In June, Staff met with AG Alliance and members of the Lost Creek GWMD to <br /> discuss the Notice of Violation issued to AG Alliance last fall (involving <br /> irrigation of unauthorized acres), and to perform a field inspection to confirm <br /> compliance. The owners have made significant changes to the plumbing and <br /> operations of the wells to allow for irrigation of one circle pivot without <br /> commingling. Based on what we saw in the field and the information provided <br /> by the contractor who completed the recent work, the violation appears to <br /> have been appropriately addressed. A meter is now installed on the involved <br /> well, and the Commission is requiring regular readings and inspections by an <br /> unbiased 3rd party to confirm ongoing compliance. <br /> Upper Black Squirrel <br />
