Staff Activity Report <br /> August 16, 2025 GWC Meeting <br /> Page 5 of 7 <br /> • Cherokee Metropolitan District, 24GW01 (change of water right) <br /> • Rangeview Metropolitan District, 24GW04 (change of water right) <br /> • Rangeview Metropolitan District, 24GW02 (change of water right) <br /> Enforcement Items and Actions <br /> From May 2025 through August 2025, Staff responded to complaints involving alleged <br /> unpermitted use of wells and designated groundwater. Correspondence and/or field <br /> inspections were used to investigate and verify well permit compliance for many of <br /> the reported violations. The matters described below involve enforcement actions <br /> taken by staff to address new or ongoing issues in the designated groundwater basins <br /> Northern High Plains <br /> The Attorney General is working with staff to bring action for injunctive and other <br /> relief to enforce over-pumping orders issued to well owners between 2019 and 2023. <br /> In 2024, these well owners (already under existing orders) again exceeded their wells' <br /> individually permitted allocations. The complaints for injunctive relief include <br /> penalties of up to $500 per day of violation and court costs, and attorney fees. The <br /> "$ per day" fines are determined using the volume of water overpumped and the <br /> well's most current pumping rate (e.g. Well X pumped 30 AF over its permit at 700 <br /> GPM. How many days did it take the well to pump 30 AF? 10 Days.) <br /> The complaints involve the following owners: <br /> • Plains GWMD - Larry Feldhousen (17.9 af over permit) <br /> • Frenchman GWMD - Faye and Bruce Hummell (28.2 af over permit) <br /> • Sandhills GWMD - Karan Harsh (18.3 af over permit) <br /> The fines and fees stated in the associated consent decrees range from $3000 - $6000. <br /> The owners have paid the fines and signed consent decrees.
