October 1, 2024
Q: My decree for my water right doesn't include any requirements for me to
measure my diversions. Do I still have to comply with the Measurement Rules?
A: Yes. Under their statutory authority to require measurement, CA may require
more stringent measurement requirements than included in a water court decree.
Likewise, a water court decree may include more stringent measurement
requirements than included in the Measurement Rules, and a water user would
need to comply with those decree requirements. In most of those instances,
compliance with the decree requirements is also likely to be sufficient under the
Measurement Rules. In the unlikely event a water court decree conflicts with the
Measurement Rules, that will need to be addressed on a case-by-case basis, and a
variance under Rule 11 might be appropriate.
