October 1, 2024 <br /> Page 3 of 4 <br /> Q; What is the "normal operating range" of a Diversion Structure or Other <br /> Structure for the purposes of Rules 6.1.2, 6.1.3, 6.1.4, and 6.1.7? <br /> A: "Normal operating range" is meant to exclude situations where water is being <br /> Diverted under limited, extreme, or special circumstances (for example, flushing <br /> flows at the beginning of the irrigation season). The normal operating range will <br /> vary from structure to structure. Because of this variability, Water Users are <br /> encouraged to direct questions about the normal operating range of their structure <br /> to their Water Commissioner. <br /> Q: Do the Rules, in particular Rule 6.1.10.1 requiring On-Stream Reservoirs to <br /> have outlets capable of releasing all out-of-priority inflows, apply to existing <br /> reservoirs? <br /> A. Yes. In some instances, the strict application of Rules, including requiring the <br /> installation of outlet works for existing reservoirs, might present practical <br /> difficulties or cause undue hardship. In those cases, the Division Engineer will <br /> consider applications for variances under Rule 11. <br /> Q: What is the process for getting approval of a pre-existing Measurement <br /> Method under Rule 7.1? <br /> A: DWR plans to perform an inventory of existing Measurement Methods using its <br /> database to track whether a Water User's pre-existing Measurement Method <br /> complies with the Rules and plans to send notices in writing by mail or email to <br /> water users if the pre-existing Measurement Method is approved or denied. <br /> However, it is likely that DWR's database will not include every single structure or <br /> might not include up-to-date contact information for the Owners of those <br /> structures. Water Users are ultimately responsible for compliance with Rule 7.1 by <br /> the appropriate phase-in deadlines, and so they are strongly encouraged to contact <br /> their Water Commissioner or the Division Engineer about approval of pre-existing <br /> Measurement Methods. <br /> Q: Do I have to provide the information listed in Rule 7.2 for the approval of a <br /> newly installed, reinstalled, or changed Measurement Method in writing? <br /> A: Yes. Division 7 plans on creating a form for submitting this information. <br /> Q: What sort of evidence do I have to provide under Rule 7.3 to show that my <br /> Measuring Device is properly rated and installed? <br /> A: For most Measuring Devices, photographs of the device will be sufficient. The <br /> Division Engineer may choose to physically inspect the structure to confirm that <br /> the Measuring Device is properly rated and installed. <br /> Q: Will declaring a Diversion Structure inactive indicate an intent to abandon <br /> the associated water right(s)? <br /> A: No. The inactivation of a structure under the Measurement Rules, in and of <br /> itself, is neither proof nor disproof of intent to abandon any water right associated <br /> with the structure. <br />
