Ground Water Commission Meeting Minutes Page 12 <br /> November 15, 2024 <br /> comply with the rules in place. <br /> Chairman Arnusch then asked the Commissioners if they had any final comments. <br /> There were no additional comments, and Chairman Arnusch asked if any of the <br /> Commissioners would like to put forth a motion. <br /> Commissioner Keeler moved to deny the variance request to Rule 5.6.1.D.1. <br /> Commissioner Tietmeyer seconded the motion, which carried unanimously. <br /> Chairman Arnusch called for agenda item no. 7, the staff activity report. Ms. Joanna <br /> Williams addressed the Commission. Ms. Williams provided an update on some items <br /> affecting Designated Basins: <br /> 1. On November 12th, Staff sent the first batch of abandonment letters (63 in <br /> total) to well owners where a replacement well was constructed but no <br /> abandonment report was received for the original well. This included small <br /> capacity wells in Upper Black Squirrel Creek. <br /> 2. Staff has begun the process of cleaning up the well permit database for <br /> designated basin permits. The cleanup involves removing unnecessary records <br /> and streamlining the imaged documents associated with the permits. Ms. <br /> Williams thanked Chris Grimes for his hard work on the project and commented <br /> that the cleanup of records will assist water users with better understanding <br /> their individual water rights and well permits. <br /> Chairman Arnusch called for agenda item no. 8, the Attorney General's report. <br /> Ms. Emilie Polley opened her remarks by providing updates on some of the cases <br /> currently in work. Ms. Polley wished to highlight two cases in particular. <br /> 1. Regarding the Gourley case no. 34GW10, a notice of appeal was sent on August <br /> 27th. Staff has not received service of the appeal. The case is currently open in <br /> Baca County Court. <br /> 2. Regarding the Cherokee case no. 08GW71, a hearing was held on July 8th. The <br /> hearing officer has issued a second revised findings and order. There are some <br /> outstanding items to wrap up for the case, but that work should be finished <br /> soon. <br /> Chairman Arnusch called for agenda item no. 9, Management District Reports <br /> Mr. Nate Midcap, reporting for the Marks Butte, Frenchman, Sandhills and Central <br />
