Simpson, P.E. <br />secretary <br />At its meeting on June 6, 2000 the Board of Examiners of Water Well Construction and <br />Pump Installation Contractors reviewed the following policy to determine its <br />compatibility with the current procedures of the Division of Water Resources and the <br />complaint procedures of the Board, and the necessity of the policy since adoption of the <br />revised Water Well Construction Rules(2000). At its meeting on October 1, 2002 the <br />Board determined that "pond wells" are constructed essentially the same as gravel pits <br />and amended the existing policy to include pond wells permitted by the Ground Water <br />Commission or State Engineer. <br />Resolution 90-1; December 4, 1990, Gravel pit wells; October 1, 2002, Pond <br />wells. <br />As a result of its review, the Board determined that Resolution 90-1, although fully <br />applicable in its content and purpose, requires modification to coordinate the Rule <br />numbers referenced in the policy with the numbers in the revised Water Well <br />Construction Rules(2000). The number of the policy is also changed in accordance with <br />the sequence of policies recently adopted by the Board. <br />POLICY: <br />In accordance with Rule 10.1.6 of the Water Well Construction Rules(2000) and as a <br />continuance of the concepts set forth in Resolution 90-1, the Board of Examiners of <br />Water Well Construction and Pump Installation Contractors hereby adopts the following <br />policy- <br />1. Written requests for variance, as required by Rule 1S, for gravel pit well construction <br />shall not be required when such structures are permitted by the Colorado Ground <br />Water Commission under the provisions of Section 37-90- 107(6) and the State <br />Engineer under the provisions of Section 37-90-137(11), C.R.S., nor shall a variance <br />TIMOTHY L.
