Exception for Gravel Pit Wells
Amended to Include "Pond Wells"

At its meeting on June 6, 2000 the Board of Examiners of Water Well Construction and
Pump Installation Contractors reviewed the following policy to determine its
compatibility with the current procedures of the Division of Water Resources and the
complaint procedures of the Board, and the necessity of the policy since adoption of the
revised Water Well Construction Rules(2000). At its meeting on October 1, 2002 the
Board determined that "pond wells" are constructed essentially the same as gravel pits
and amended the existing policy to include pond wells permitted by the Ground Water
Commission or State Engineer.
Resolution 90-1; December 4, 1990, Gravel pit wells; October 1, 2002, Pond
wells.
As a result of its review, the Board determined that Resolution 90-1, although fully
applicable in its content and purpose, requires modification to coordinate the Rule
numbers referenced in the policy with the numbers in the revised Water Well
Construction Rules(2000). The number of the policy is also changed in accordance with
the sequence of policies recently adopted by the Board.
POLICY:
In accordance with Rule 10.1.6 of the Water Well Construction Rules(2000) and as a
continuance of the concepts set forth in Resolution 90-1, the Board of Examiners of
Water Well Construction and Pump Installation Contractors hereby adopts the following
policy-
1. Written requests for variance, as required by Rule 1S, for gravel pit well construction
shall not be required when such structures are permitted by the Colorado Ground
Water Commission under the provisions of Section 37-90- 107(6) and the State
Engineer under the provisions of Section 37-90-137(11), C.R.S., nor shall a variance
