Cattany <br />Division Director <br />Idaho Springs, CO 80452 Natural Resource Trustee <br />RE: Notice of Intent to Conduct Prospecting; DRMS File # P-2009-028; Spring <br />Gulch; Adequacy Review and Request for Additional Information <br />Dear Mr. Winters: <br />The Division received your Notice of Intent to Conduct Prospecting on September 09, <br />2009. The application is substantially incomplete and inadequate with a couple of small <br />exceptions. This notice will continue to be deficient until a significant effort is <br />undertaken to accurately and completely fill out the notice. Following is a list of these <br />deficiencies that will require the submittal of additional information or clarification of the <br />submitted information. The responses need to fully address each section of the Notice of <br />Intent Application and the appropriate sections. of Rule 5 and Rule 3 of the Mineral Rules <br />and Regulations of the Colorado Mined Land Reclamation Board for Hard Rock, Metal <br />and Designated Mining Operations. If you do not adequately respond to the following <br />concerns that have been identified as incomplete or inadequate within 60 days, the notice <br />will be terminated. <br />General Comments <br />All sections of the Notice of Intent Form must be addressed in appropriate detail to allow <br />the Division to fully evaluate the proposed environmental impacts of the prospecting and <br />reclamation activities and be able to adequately calculate the required financial warranty <br />associated with those activities. It is quite obvious from our inspection that a significant <br />amount of surface disturbance that is related to your prospecting activities has already <br />occurred on your site including road construction, adit/tunnel development, water <br />diversion, storage and pumping, ore processing, processing waste disposal, building <br />construction, excavations, etc. All of these activities must be described in the appropriate <br />sections of the Notice of Intent Form and included on a map that accurately depicts these <br />activities. <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
