April 1, 2013 <br />Dear Mr. Hays: <br />Climax Molybdenum <br />A Freeport - McMoRan Company <br />Via Email and Certified Mail #: 7006 2150 0001 8831 6598 <br />Mr. Peter Hays <br />Division of Reclamation, Mining and Safety <br />1313 Sherman St., Rm. 215 <br />Denver, CO 80203 <br />Re: Follow -up Notice for Mill Drop Tower 4 and 5 Failure, Permit No. M- 1977 -342 <br />Henderson Mill is providing this written follow -up notice to a phone call made to you on March 26, 2013 <br />pursuant to Rule 8.1 and 8.2 of the DRMS Rules and Regulations. <br />This notice is regarding tailing slurry which escaped through Drop Towers 4 and 5, energy /flow <br />dissipation structures on the Tailing Delivery Line (TDL), which was observed on March 26 2013 at <br />11:45am. The TDL is considered an Environmental Protection Facility with the Mill Process Water <br />System, in Henderson's Environmental Protection Plan. When the leaks were discovered, an estimated <br />volume between 75 -100 gallons at each tower had leaked on to the ground. <br />(a) After discovering the issue, Henderson employees promptly diverted all flow to the <br />Emergency Cutout Line to stop any additional release. <br />(b) Mill tailing slurry flow did not adversely, impact human health, property or the <br />environment. Slurry accumulated directly under each tower and did not flow. The patch was located where the TDL <br />
