In order to ensure continuity of the comments and responses, <br />Colowyo has restated without modification; the Division's original comments <br />(bold black text), Colowyo's first round response (italicized black text), the <br />Division's follow up comments (bold black text), and finally Colowyo's response <br />to the Division's follow up comments (italicized red text) for each issue raised. <br />1) DRMS Original Comment: <br />Over the last five years, the Division, Colowyo Coal Company staff, <br />and CCC consultants have put in a great deal of time and effort <br />focused on preventing water quality violations and improving the <br />safety of public users of Highway 13 below Prospect Pond. This effort <br />has included improving modeling accuracy. Colowyo most recently <br />updated the approved curve numbers at the mine through technical <br />revision 73 (TR -73, June 2009). As part of TR -73, Colowyo identified <br />soils on the mine site as C soils and associated CN values were <br />approved. <br />Colowyo's June 25, 2012 Response to Comment 1 above: <br />Colowyo Coal Company is aware of the sensitivity regarding Prospect <br />pond and its proximity to Highway 13. In view of this, CCC is proposing <br />with this response to retain the TR -73 input assumptions for the Prospect <br />basin, specifically the curve numbers assigned in TR -73. A revised Table <br />I is attached which retains the TR -73 Curve Numbers for Prospect but <br />A Western Fuels- Colorado, LLC mining property <br />
