Box 247 <br /> Silverton, Colorado 81433 <br /> RE: Sunnyside Mine - File No. 77-378 <br /> Dear Mr. Murray: <br /> Action by the Colorado Mined Land Reclamation Board at their meeting resulted <br /> in a finding that there is reason to believe that a violation exists at the <br /> above-captioned operation (34-32-124 1 , C.R. �,e__ <br /> This matter will be on the Board agenda as a Formal Public Hearing on <br /> October 23-24, 1985 for consideration of the possible violation, possible <br /> cease and desist order, possible corrective action(s) and possible civil <br /> penalty. <br /> At the hearing, which will be held in Room 110 of 1313 Sherman Street, Denver, <br /> Colorado, beginning at 9:00 A.M. or as soon thereafter as the matter can be <br /> considered, you will have the opportunity to be represented and heard. <br /> The Division will present facts to the Board pertaining to the possible <br /> violation, specifically as follows: <br /> 1 . Mine refuse at the American (Gladstone) tunnel site is inadequately <br /> disposed. The Division believes that this is a violation of <br /> C.R.S. 34-32-116(1) (e) . <br /> 2. Mine water treatment sludge, a potentially acid forming and toxic <br /> producing material is being disposed in a pond along the banks of the <br /> Animas River. The Division believes that this site is inadequately <br /> protected from potential flooding and that the pond may not be adequately <br /> lined to minimize effects to the groundwater in the river alluvium.
