Drainage and runoff control at the tailings disposal site below the <br /> Mayflower Mill is inadequate in that surface runoff and springs are not <br /> diverted away and around the lower tailings disposal ponds. The Division <br /> believes that this system is not adequately designed or constructed to <br /> minimize effects to the hydrologic balance and that this is a violation of <br /> C.R.S. 34-32-116(1)(h) . <br /> 4. Surface water, which previously flowed to Lake Emma, is draining into the <br /> mine. The Division believes that this is a violation for failure to <br /> minimize effects to the hydrologic balance in that both surface water <br /> quality and quantity is unnecessarily affected. The Division believes <br /> that this is in violation of C.R.S. 34-32-116(l )(h) . <br /> If the Board finds violation, it will then consider possible civil penalties <br /> at that same hearing.
