Dear Tony,
This letter is in response to your inspections on June 2nd, and June 7 and your
concerns resulting from those ins itlons.
1. Set up and use of a water pump outside the approved affected area to
divert water. This pump was set up at this location as a result of the town
of Alma's request. The pump was being set by our crew inside the permit
when a representative from the town demanded that it be moved. As a
result the pump was set approximately 15 feet off of the permit boundary.
Mike Itel the Water Commissioner verbally approved this location as a
temporary water source. The pump was moved back to within the permit
area on June 9` On June 13 the Columbia Ditch was opened and we
discontinued the use of the pump at that time.
2. We have not properly installed the approved process water treatment
Ponds in accordance with the approved application. Furthermore, ponds
that have been installed are malfunctioning by allowing leakage and loss
of containment of the process water. We have always used a three -pond
system to settle out our fines from the wash plant. The first two ponds are
long and narrow so that an excavator can clean them daily. The third pond
is much larger in order to settle out the very fine particles. This pond
developed a leak as we unknowingly built it over a deposit of clean
cobble. The pond was sealed with crushed fines on June 9
3. We have failed to install storm water control ponds 4, 5, & 6 and their
associated collection ditches as required by the approved surface water
managementplan. The collection ditch was rebuilt on July 5 and pond
#4 was increased to the designed size on August 4 As a result of your
follow up inspection we are going to wait to construct ponds 5 and 6
because we have not yet impacted those areas.
