11 -15 -2011
Michael Cunningham
DRMS
Dear Sir,
In response to your accuracy review letter dated 11 -02 -2011, I have compiled the following responses
listed in sequence as per your letter.
1.
The Colorado Division of Water refers to the source of water used on site. This water is purchased from
the City of Fort Collins and trucked in. The State issued a commercial well permit number 286460 to
Stone Wholesale, Inc. on 8 -15 -2011. We expect to begin use of the well sometime in December of 2011.
No more water will be trucked in after this as our well use is below the 108,000 gallon limit on the
permit. The Army Corp of Engineers letter discusses the issues of discharge of dredged or fill material
runoff into lakes, streams and irrigation ditches. The storm water on site is controlled as per the permit
issued by the State number cor34 -1454. The water used for the sawing process is only lost by
evaporation and this is Tess than 50,000 gallons annually.
2.
_Proof of publication of public notice once a week for four consecutive weeks in the Coloradoan has been
sent to Michael Cunningham.
3.
A new EXHIBIT C has been prepared that covers A thru 1, is included in the packet.
EXHIBIT D
4.
The new maximum disturbed area will be 41.78 acres as 3.03 will be added to 38.75.
/44- )997
,/,94y/
16 18 2011
ivialon of Reclamation,
Mining and Safety
5.
Overburden from the 3.03 additional acres will be used for reclamation in the existing disturbed area.
This will be also stockpiled in the northern most portion of the existing disturbance to replace the
material extracted as reclamation proceeds.
6.
The reclamation will be in stepped phases. The major push to reclaim the northernmost portion of the
quarry is beginning now as fill begins to be replaced. The additional 3.03 acres strategy is an extension of
the plan currently being used.
7.
The depth of the actual stone being quarried is 8 to 12 feet thick at the north end of the permit. The
overburden ranges from 0 to 30 feet from West to East. The deeper strata of stone quarried at the south
end of the current disturbed area is not thick enough at the north end to justify quarrying.
EXHIBIT E
