SUBJECT: Western Fuels - Colorado, New Horizon North Mine (Permit No. C- 2010 -0$9),
New Permit Application Review of Adequacy Responses
I have reviewed Western Fuels- Colorado's (WFC's) responses to our preliminary adequacy review
for the New Horizon North Mine permit application and have the following remaining comments.
The following paragraphs correspond to my original adequacy review memos and are listed in the
order presented in WFC's May 26, 2011 response letter.
2.04.5 General Description of Hydrology and Geology

7. WFC submitted entirely new overburden sample data for the NHN permit area. The new
data is acceptable and closely followed our guidelines for the collection of overburden
geochemistry data. The laboratory analytical methods as presented in Appendix Table
2.04.6 -3 data sheets are also consistent with our guidelines. The Division requests the
following clarifications. On Appendix Table 2.04.6 -2 the summary table for the overburden
data, WFC presents total results for Mercury, Mo, and Se. For mercury we understand that
only a total digestion can be done, but for Mo and Se both total and soluble fractions were
analyzed for all overburden samples. Please clarify why the total result was presented on
Appendix Table 2.04.6 -2 instead of the soluble fraction as suggested by our guidelines for
