Everist, Inc. requests complete and final release of the French property section of the Lohmann <br />Sand and Gravel mine, DRMS Permit M-2001-017. <br />The reclamation plan was revised and approved by Technical Revision last June (June 22, 2010) to <br />updated the lake configuration and include the Kerr-McGee well on the east side of the property. <br />A financial warranty reduction was also approved last June (June 24, 2010) for the French property <br />section due to the majority of the reclamation being completed - the SEO-approved lining, the backfilling <br />and sloping, and the seeding for final vegetation. <br />The only thing remaining for final reclamation was substantial and sustainable vegetation. The property <br />was seeded and has had substantial growth. Unfortunately, Mr. French, the landowner, has disked a lot <br />of vegetation this spring. Mr. French would like to have the property released and back in his control. We <br />have sent a letter to Mr. French request an acknowledgment from him approving the vegetation as is and <br />requesting release of the property from the DRMS permit. <br />As soon as we get the signed acknowledgment letter back from Mr. French, we will forward it to you. A <br />copy of the letter 'is -attached for reference in the meantime. <br />We look forward to scheduling a final inspection with you soon.
