Everist, Inc. is requesting complete and final release of the French property section of the Lohmann <br />Sand and Gravel mine, Division of Reclamation Mining and Safety (DRMS) Permit M-2001-017. <br />As you know, in June 2010, the DRMS approved a Technical Revision to revise the reclamation plan, and <br />the Division also approved a financial warranty reduction due to the majority of the reclamation being <br />completed - the SEO-approved lining, the backfilling and sloping, and the seeding for final vegetation. <br />The only thing remaining for final reclamation and release was substantial and sustainable vegetation. <br />The property was seeded and has had substantial growth. Unfortunately, a lot of vegetation was disked <br />by Mr. French this spring. The amount of sustainable vegetation growth that is usually acceptable to the <br />DRMS prior to final release could take at least another year. <br />However, L.G. Everist has spoken to the DRMS and requested release of your land, knowing that you <br />would like to have control over it again. The DRMS may approve release if you, Mr. and Mrs. French, <br />landowners of the property for which we are asking for release, will acknowledge by your signatures at <br />the bottom of this letter that the amount of vegetation currently on the property is acceptable as is to you <br />and that you would like to have the property released from the state mine permit. <br />Please note that once we receive approval from the DRMS, we will still have to request release of your <br />property from the Weld County USR permit. <br />If you have any questions, please contact Lynn Mayer Shults - telephone is 303-286-2247, and email is <br />Imshults@lgeverist.com. <br />Sincerel <br />Lynn Mayer Shults <br />Regulatory Manager <br />cc: Dennis Fields, Vice President <br />Please sign below if you agree that the growth and type of vegetation on the French property section owned by you of <br />the Lohmann Sand & Gravel Mine (located in Sec 6, T2N, R67W) is acceptable to you as is, and that you would like <br />your property released from the DRMS Permit # M-2001-017. <br />Signature - James M.
