The decision date for this permit application is October 6, 2010. The Division of Reclamation, <br />Mining, and Safety (Division) is required to make a decision by October 6, 2010. Therefore, your response to the <br />following adequacy review concerns should be submitted to the Division as soon as possible. <br />1. As required by Rule 1.6.5 (2), please submit the proof of publication of the public notice circulated in the <br />local newspaper and all owners of record of surface lands, and easement holders that are on the affected land and <br />within 200 feet of the boundary of the affected land. Proof of notice may be return receipts of a Certified Mailing <br />or by proof of personal service. <br />2. Application Form - The information regarding Permitted Acreage, item #3, is not clear as to the current <br />permitted acreage, the acreage proposed to be added, and the final proposed total acreage. The information on the <br />application form also does not correlate with that contained in the application. Please submit a new page one of <br />the application with the corrected acreage information. <br />Rule 6.4.4 Exhibit D - Mining Plan ° <br />3. The submitted Mining Plan states, "Additional areas will be used for stockpile of pit run, product, <br />overburden, soil,..." If the areas that will be used for these activities are not included in the 10 acres used for <br />processing plants and hot mix asphalt facilities, please specify how much additional land will be used for the <br />stockpiling activities. 11, <br />4. Item number 3 under Assumptions, in the submitted Mining Plan state, "Based on the normal requirement <br />to provide six inches for rooting zone/soil on reclaimed areas, it is estimated that only acre-feet of a required acre- <br />feet of soil (44%0 will be available for final reclamation." Please clarify this statement. <br />5. The section titled Stripping and Mining Technique in the submitted mining plan states, "Soil may be <br />screened to remove roots and larger materials for processing and sale or use,..." Elsewhere in the application it <br />states that there will not be enough topsoil at the site to supply 6 inches of topsoil for reclamation purposes.
