Dear Mr. Hamrick:
The Colorado Department of Public Health and Environment's Water Quality Control Division (the
"Division") received Cotter Corporation's ("Cotter) June 26, 2010, plan and expedited time
schedule for the implementation of interim measures that Cotter will implement to reduce or
mitigate the concentrations of pollutants in the unauthorized discharge at Schwartzwalder Mine.
The plan and time schedule were submitted in response to paragraph 27 of the Notice of
Violation/Cease and Desist Order, Number: I0-100601-1 (the "NOV/CDO"), that the Division
issued to Cotter on June 1, 2010.
The Division hereby authorizes Cotter to discharge from the temporary 50 gpm water treatment
system in accordance with the submitted plan and time schedule and the following alternate and
additional terns and conditions:
1. Cotter shall perform weekly Radium 226+228 monitoring, as opposed to the monthly frequency
proposed in the submitted plan and time schedule.
2. Cotter's discharge from the interim water treatment system shall not contain effluent parameter
concentrations which exceed the following limitations:
