Request for Technical Revision (TR) to <br />Wagner/Kauffman Pit #3, M-1999-069, Larimer County, Colorado for <br />Proposed City of Loveland Boyd Lake Avenue Extension <br />Eric: <br />Pursuant to previous informal inquiries and discussions over the past year's time, please find <br />attached information and materials detailing a formal request for a Technical Revision (TR) to <br />the 112 Regular Operations Permit M-1999-069, held by Jake Kauffman & Son, Inc. This <br />Permit is for mining sand and gravel aggregate materials in Larimer County, Colorado. We <br />appreciate your patience and availability for consultation while the final agreements for this <br />change have been put in place, and these informational materials have been developed. <br />Generally, this TR is being requested to allow for construction of a roadway embankment for <br />a portion of the proposed future extension of Boyd Lake Avenue through the subject mining <br />pit. The roadway embankment construction is proposed to roughly bisect the permit property, <br />as illustrated in the attached, revised Exhibit F Reclamation Plan map. This embankment will <br />encroach upon the proposed reclaimed "East Reservoir", cutting off the approximately 10 <br />acre northwest comer of this reservoir. This will change the proposed reclamation and after- <br />use of the property. <br />The City of Loveland has officially purchased the actual road right-of-way property, as <br />illustrated on the attached, updated Exhibit O Property Ownership map. I have also attached <br />a new Right of Entry authorization letter from the City of Loveland to update the Exhibit N <br />Right of Entry for the Permit. The authorization letter grants Jake Kauffman & Son, Inc., as <br />the Permit holder, mine operator and party responsible for final reclamation, the right to enter <br />the property to conduct activities in conformance with the approved Mining and Reclamation <br />Plans, including this TR request. <br />The identified roadway embankment area will be filled in years 2010-2011, covered with <br />topsoil, and revegetated as pasture ground until such time as the City of Loveland <br />commences final construction of the road.
